Competition Terms & Conditions

SWELL WOOLGOOLGA WEEKEND GIVEAWAY TRADE PROMOTION TERMS & CONDITIONS NSW – PRIZE POOL UNDER $10,000

These terms and conditions apply to all entries into and/or prizes awarded under the promotion to win a SWELL WOOLGOOLGA WEEKEND PRIZE PACK commencing Thursday 3 September 2026 (Promotion). The laws of NSW apply to the conduct of the Promotion and the interpretation of these terms and conditions. By submitting an online entry into this Promotion, entrants (Entrants) warrant that they have read, understood, and are deemed to have accepted and agreed to be bound by these terms and conditions.

1. PROMOTER

This Promotion is conducted by WPT Land Developments 3 Pty Ltd (ABN 29 654 894 729) and its associated entities, of Level 1, Suite 22, 5 Snapper Drive, Lennox Head, NSW 2478 (“Promoter”).

2. PROMOTION PERIOD

The Promotion commences on Thursday 3 September 2026 at 12.00pm and closes on Thursday 1 October 2026 at 11.59am (“Promotion Period”).

3. ELIGIBILITY

Entry is open to Australian residents aged 18 years or over. Directors, officers, management and employees of the Promoter, its related bodies corporate, participating prize partners, suppliers and agencies involved in the conduct or administration of the Promotion, and their immediate family members, are ineligible to enter.  For these purposes, immediate family includes a spouse, de facto spouse, parent, child or sibling, whether or not they live in the same household.

The Promoter may require an Entrant or winner to provide proof of age, Australian residency, identity and eligibility to the Promoter’s reasonable satisfaction. Failure to provide satisfactory proof may result in the entry being declared invalid or the prize being forfeited.

4. ENTRY

To enter the promotion, entrants must complete one of the following:

Facebook Entry

• Like the competition post on Facebook here.
• Follow the Swell Woolgoolga Facebook page.
• Tag at least one (1) friend in the comments of the competition post.

Instagram Entry

• Like the competition post on Instagram here.
• Follow the Swell Woolgoolga Instagram account.
• Tag at least one (1) friend in the comments of the competition post.

Entrants may enter once on each platform to receive one (1) or two (2) entries.

Bonus Entries

• Entrants may receive one (1) additional entry for each additional friend tagged in a separate comment (tags/comments must be made on an identified competition entry post).
• Each tagged friend must be a real individual and must not be the entrant themselves.
• There is no limit to the number of eligible entries that may be submitted through additional friend tags.

General Conditions

• To be eligible, entrants must continue to follow the Swell Woolgoolga social media account on the platform through which they entered until the winner is drawn.
• Automated, bulk, or computer-generated entries will not be accepted.
• Incomplete, indecipherable, or fraudulent entries will be deemed invalid.
• Each Entrant is responsible for ensuring that their entry complies with the applicable social-media platform rules and does not infringe the rights of another person.
• The Promoter may reject any entry that appears to be illegible, forged, copied, manipulated, tampered with or otherwise not submitted in accordance with these terms and conditions.
• The Promoter may disqualify an Entrant who tampers with the entry process, uses scripts or other automated means, submits an entry through multiple or false accounts, or otherwise abuses any aspect of the Promotion.
• If there is a dispute about the identity of an Entrant, the Promoter may determine the identity of the Entrant in its reasonable discretion.

Any additional entry instructions or bonus entry opportunities will be stated in the promotional post.  If there is an inconsistency, these terms and conditions prevail to the extent of the inconsistency.

5. PRIZE

One (1) prize will be awarded:

The prize package includes a curated collection of local accommodation, dining and visitor experiences valued at AUD $2000 (RRP).

The prize is:

• Not transferable or exchangeable, unless approved by the Promoter.
• Not redeemable for cash.
• Subject to availability, booking conditions and the individual terms and conditions of each prize provider.
• Subject to any stated validity dates, blackout dates or other restrictions imposed by participating prize providers.
• Travel and transportation are not included as part of the prize. The winner is responsible for arranging and funding their own travel to Woolgoolga (or the relevant participating venue) to redeem the prize components.
• All prize values are in Australian dollars and are correct at the commencement of the Promotion. The Promoter accepts no responsibility for any variation in value after that time.
• If the prize or any component becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute a prize or component of equal or greater value, subject to applicable law and any direction of a regulatory authority.
• To the extent permitted by law, the Promoter gives no representation or warranty about merchantability, suitability or fitness for purpose of the prize or any prize component. Nothing in these terms excludes any guarantee, warranty or right that cannot lawfully be excluded.
• The winner is responsible for all costs associated with accepting and using the prize that are not expressly included.

6. DRAW

The winner will be determined by random draw conducted at Level 1, Suite 22, 5 Snapper Drive, Lennox Head, NSW 2478 on Thursday 1 October at 2.00pm.

The first entry drawn that is valid under these terms and conditions will be the winning entry. If a drawn entry is invalid, the Promoter may continue drawing until a valid winning entry is identified.  The Promoter’s decision is final, and no correspondence will be entered into.

7. NOTIFICATION AND UNCLAIMED PRIZE

The winner will be notified by direct message on the platform on which they entered, within two (2) business days of the draw.

The Promoter may require the winner to provide proof of identity and eligibility and evidence that the winning entry was valid before awarding the prize.

The Promoter will make reasonable attempts to contact the winner using the contact details available to it. The Promoter is not responsible for incorrect, incomplete or out-of-date contact details supplied by an Entrant.  Entrants must be able to check messages on their platform of entry, including any spam folders.

If the winner does not claim the prize within fourteen (14) days of notification, the Promoter reserves the right to conduct a redraw.

The winner must book and redeem each prize component within its stated validity period and comply with the relevant provider’s booking requirements. A component not used within its validity period will be forfeited, unless the provider or Promoter agrees otherwise.

8. PUBLICATION

By entering this Promotion, Entrants agree that their name may be made public. In particular, the winner’s first name and postcode may be published on the Promoter’s website and/or social media channels.

The Promoter may ask the winner to participate in a prize-acceptance photograph or video and may request permission to publish the winner’s name, image and footage for reasonable promotional purposes. Any use will be subject to the winner’s consent and applicable privacy law.

Photographs and illustrations used to advertise the Promotion are for illustrative purposes only and may not depict the exact prize components.

9. PRIVACY & MARKETING CONSENT

By entering this Promotion, Entrants consent to the Promoter collecting and handling their personal information for the purposes of:

• administering and promoting this Promotion;
• contacting and verifying the winner; and
• awarding and publicising the prize; and
• providing information about the Promoter’s products and services.

The Promoter collects personal information because it is necessary to administer the Promotion. If an Entrant does not provide the requested information, the Promoter may be unable to accept the entry or award the prize.  Personal information will be handled in accordance with the Promoter’s Privacy Policy available at www.clarenceproperty.com.au

Entrants may opt out of receiving marketing communications at any time by unfollowing the social account they followed as part of the Promotion (after the completion of the Promotion).

10. LIABILITY

To the extent permitted by law, including schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law), the Promoter and its associated subsidiaries, employees, advisers, agents, and related bodies corporate shall not be liable for any loss or damage of whatsoever nature however occasioned to any person by, through or in connection with the Promotion (including but not limited to direct, indirect, or consequential loss or damage or personal injury).

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, the winner indemnifies the Promoter and its related bodies corporate, employees, advisers, agents and prize providers against claims, losses, damages, costs and expenses arising from the winner’s unlawful act, negligence or breach of these terms in connection with acceptance or use of the prize.

To the extent permitted by law, Entrants waive claims for punitive, incidental or consequential damages arising from participation in the Promotion, other than rights and remedies that cannot lawfully be waived.

The Promoter is not responsible for a failure of any website, social-media platform, telecommunications network, server, software or email system, or for any delayed, lost, damaged, illegible or misdirected entry or communication, except to the extent caused by the Promoter or as otherwise required by law.

If the Promotion is affected by tampering, fraud, unauthorised intervention, technical failure or another cause beyond the Promoter’s reasonable control that impairs its administration, security, fairness or proper operation, the Promoter may suspend, modify or terminate the Promotion, subject to applicable law and any direction of a regulatory authority.

An attempt to deliberately damage a website or social-media account used for the Promotion or to undermine the legitimate operation of the Promotion may violate civil or criminal law. The Promoter reserves its rights to seek available remedies.

The Promotion is void where prohibited or restricted by law.

The Promoter reserves the right to vary the terms of, or cancel, this Promotion at any time with or without notice and without liability to any Entrant or other person, subject to applicable laws.

11. DECISIONS AND INTERPRETATION 

The Promoter may accept an entry containing a minor error or omission where doing so does not compromise the fairness or integrity of the Promotion.

The Promoter may determine any dispute about the identity of an Entrant, the validity of an entry or the interpretation of these terms in its reasonable discretion. The Promoter’s decision is final, subject to applicable law.

Entrants are responsible for reviewing these terms and may obtain independent advice before accepting a prize.
